Judge Jeremy Kernodle ruled that CMS violated the No Surprises Act by publishing guidelines on the Qualified Payment Amount that contradicted the law in several ways. However, Judge Kernodle ruled against the plaintiffs by deciding that the QPA does not have to be transparent.
